Açık Radyo ile ilgili yargısal süreçte olumlu bir aşamayı daha katetmiş bulunuyoruz.
Radyo ve Televizyon Üst Kurulu (RTÜK) tarafından verilen yayın durdurma ve para cezası kararı aleyhine açılan davada Ankara 21. İdare Mahkemesi tarafından 08.07.2024 tarihinde 'yürütmeyi durdurma kararı' verilmiş, bu karara RTÜK tarafından itiraz edilmişti.
Ancak, Ankara Bölge 10. İdare Mahkemesi’nin 2024/1948 sayılı ve 01.08.2024 tarihinde verdiği ve bugün itibariyle Ankara 21. İdare Mahkemesi’ne iade edilen dosyadaki itiraza ilişkin kararında: "Dava dosyasında mevcut bilgi ve belgelere göre mahkemece yürütmenin durdurulması istemi hakkında verilen kararında yasaya aykırılık bulunmadığından itiraz isteminin reddine karar verilmiştir" denilmektedir.
Bu karar radyomuz için olduğu kadar, ülkedeki ifade ve basın-yayın özgürlüğü açısından umut vericidir; hukuk ve yargı işleyişi açısından da önemli bir duraktır.
Yargısal süreç devam edecek olmakla beraber bu karar ile radyomuzun yayınlarını sürdürmesi ile ilgili ciddi bir engel aşılmıştır.

Court Rejects Objection of RTÜK, the Radio and Television Supreme Council
We have now taken another positive stride in the judicial process regarding Açık Radyo.
In the case filed against the broadcast suspension and monetary fine decision made by RTÜK [the Radio and Television Supreme Council], the Ankara 21. Administrative Court had previously ruled, in its verdict dated 08.07.2024, for a stay of execution, and RTÜK had then filed an objection against this verdict.
However, in its verdict no. 2024/1948 regarding the objection, returned to the Ankara 21. Administrative Court on 01.08.2024, the Ankara 10. Administrative Court states that “Since no inconsistency with the law has been found in the court’s verdict regarding the demand for a stay of execution in view of existing information and documents in the court file, the objection to the verdict has hereby been rejected”.
This verdict provides hope not only for our radio, but for freedom of expression and the freedom of the press in our country; it presents a significant moment regarding legal and judicial process.
The judicial process continues - however, a critical obstacle regarding the continuation of our radio’s broadcast has been surpassed.
