Değerli dostlarımız,
Kamuoyuna RTÜK tarafından da duyurulduğu üzere; RTÜK’ün 22.05.2024 tarihli kararı ile Açık Radyo’ya, 6112 sayılı Radyo ve Televizyonların Kuruluş ve Yayın Hizmetleri Hakkında Kanun’un 8. Maddesinin 1. fıkrasının b) bendinde yer alan, yayın hizmetleri 'Irk, dil, din, cinsiyet, sınıf, bölge ve mezhep farkı gözeterek toplumu kin ve düşmanlığa tahrik edemez veya toplumda nefret duyguları oluşturamaz.' ilkesinin ihlali nedeniyle idari para cezası ve Açık Gazete programının yayınına beş gün durdurma cezası verilmiştir. Keza, anılan kararda, ihlalin bir yıl içinde tekrarı halinde, yayının on güne kadar durdurulacağı ve bir kez daha tekrarı halinde Açık Radyo’nun yayın lisansının iptal edileceği ihtar edilmiştir.
Verilen kararın gerekçesi, 'Açık Gazete' programımızın 24 Nisan 2024 tarihli yayınındaki ifadelerdir.
Karardaki ifadeye göre; “… yayına katılan konuğun “…Ermeni, yani Osmanlı topraklarında gerçekleşen tehcir ve katliamların, soykırım olarak adlandırılan katliamların 109. Yıldönümü, sene-i devriyesi. Bu yıl da yasaklandı biliyorsunuz Ermeni soykırım anması” şeklindeki ifadeleriyle ilgili olarak programcıların, bir düzeltme girişiminde bulunmamasının kamusal sorumluluk ve sorumlu yayıncılık anlayışıyla bağdaşmadığı gibi toplumu kin ve düşmanlığa tahrik eden ve toplumda nefret duyguları oluşturabilecek nitelikte olduğu kanaatine varılmıştır.
Anılan kararın hatalı değerlendirmeler neticesi verildiği açık olup, kararla ilgili yargısal müracaatlar yapılmıştır ve anılan sürece ilişkin gelişmeler kamuoyu ile paylaşılacaktır.
Bununla beraber, aşağıdaki hususları da şeffaflık ilkemiz doğrultusunda kısaca kamuoyu ve siz sevgili dostlarımızla paylaşmak isteriz:
Bildiğiniz gibi, Açık Radyo’nun temel sloganı “Kâinatın tüm seslerine, renklerine ve titreşimlerine Açık Radyo” olmuştur. Bu çerçevede, radyomuzun, “'Irk, dil, din, cinsiyet, sınıf, bölge ve mezhep farkı gözeterek toplumu kin ve düşmanlığa tahrik edemez veya toplumda nefret duyguları oluşturamaz.” şeklindeki bir yasa maddesini ihlal ettiğinin iddia edilmesi bile bizim için son derece anlaşılmaz ve üzücü bir durumdur.
Yargısal süreç içinde de ifade etmeye çalıştığımız üzere, Açık Radyo, ilk yayına geçtiği andan başlayarak her zaman düşünce ve ifade özgürlüğünü ve bunun doğal bir sonucu olan basın özgürlüğünü savunmuştur. Düşünce ve ifade özgürlüğü ve bunun uzantısı olan basın özgürlüğü ve halkın haber alma özgürlüğü, gerek Türkiye’nin de taraf olduğu uluslararası sözleşmelerde ve gerekse Anayasamızda ayrıntılı olarak düzenlenmiş olup; bu konuda uygulamaya yol gösterecek sayısız uluslararası ve ulusal yargı kararı da mevcuttur. Kaldı ki, ifade özgürlüğü, demokratik bir toplumun esaslı temellerinden biri olduğu gibi çoğulculuğun, hoşgörünün ve açık fikirliliğin de gereğidir.
Açık Radyo da kuruluşundan bu yana yaklaşık 30 yıldan beri bu ilkelere uygun yayın hayatını sürdürmektedir. Bu çerçevede, RTÜK kararına konu 24.04.2024 tarihli Açık Gazete yayını da aynı ilkeler doğrultusunda yapılmış olup, karardaki değerlendirmelerin evrensel hukuk ve gazetecilik ilkeleri doğrultusunda kabulü mümkün bulunmamaktadır.
Bilindiği gibi Açık Gazete programı, gerek ülkemizden ve gerekse dünyadan birçok haber kuruluşundan gelen haberlerin, objektif olarak dinleyicilere aktarıldığı, gündeme ilişkin konukların görüşlerini dinleyicilerle paylaştığı bir program olup her zaman gazetecilik etik ilkelerini öncelikle gözetmiştir. Bu doğrultuda, cezaya konu gündeki program içinde, ifade ve düşünce özgürlüğünün sınırlarını aşan bir ifade bulunmadığı gibi gerek karara konu ifadeler ve gerekse anılan programın bütünü değerlendirildiğinde, evrensel nitelikteki gazetecilik ilkelerine aykırı bir yön de bulunmamaktadır. Hele, anılan programın toplumu kin ve düşmanlığa tahrik edici ve toplumda nefret duyguları oluşturabilecek nitelikte olabilmesi mümkün değildir.
Ayrıca, şu noktayı da açıkça belirtmek gerekir: Açık Radyo, tüm programcıları ve dinleyicileriyle beraber büyük bir ailedir. Tüm programcılarımız ve dinleyicilerimiz basın özgürlüğünün kıymetinin ve getirdiği büyük sorumluluğun elbette farkındalar ve yayın hayatımız boyunca bu ilkelere dikkat etmişlerdir. Özellikle vurgulamak isteriz ki, 30 yıllık süreçte, ulusal ve uluslararası alanda tanınmış, konularında uzman bin dört yüzü aşkın programcımız, gerek habercilik alanında ve gerekse hukuk, felsefe, tarih, antropoloji, bilim, kültür, edebiyat ve sanat gibi birçok konuda yaptıkları binlerce programda evrensel gazetecilik ilkelerini her zaman ön planda tutmuşlardır; Açık Radyo olarak elbette bundan böyle de aynı ilkeler doğrultusunda ve aynı sorumlulukla yayın yapmaya devam edeceğiz.
Bu süreçte yanımızda olup, evrensel gazetecilik ilkelerini savunmamızda bize destek olan tüm Açık Radyo dostlarına tekrar teşekkürlerimizi sunar, sürece ilişkin tüm gelişmeleri sizlerle ve kamuoyu ile paylaşmaya devam edeceğimizi tekrar belirtmek isteriz.
“Kâinatın tüm seslerine, renklerine ve titreşimlerine Açık Radyo”

As announced to the public by RTÜK (Turkish Higher Council for Radio and Televison), with RTÜK's decision dated 22.05.2024, Açık Radyo was sentenced to an administrative fine and a five-day suspension of the broadcast of Açık Gazete for violating the principle in Article 8, paragraph 1, subparagraph b) of Law No. 6112 on the Establishment and Broadcasting Services of Radio and Television Enterprises and Broadcasting Services, which states that broadcasting services "cannot incite the public to hatred and hostility or create feelings of hatred in society by making distinctions based on race, language, religion, gender, class, region and religious order. Likewise, the aforementioned decision warned that if the violation is repeated within one year, the broadcast will be suspended for up to ten days and if it is repeated once more, Açık Radyo's broadcasting license will be revoked.
The reason given for the above-mentioned decision is based on the statements in the broadcast of our 'Açık Gazete' program on April 24, 2024.
According to the statement in the decision; “...The guest of the radio program stated: ‘the 109th anniversary, the anniversary of the massacres of Armenians, that is, the deportations and massacres that took place in the Ottoman lands, the massacres that are termed genocide. This year the commemoration of the Armenian genocide was also banned, you know.’...The fact that the programmers did not attempt to make a correction regarding the statements made by the guest is found to be incompatible with the understanding of public responsibility and responsible broadcasting, as well as an incitement to hatred and hostility, and creating feelings of hatred in society.”
It is clear that the aforementioned decision was made as a result of erroneous evaluations. Judicial applications have been undertaken concerning the decision and further development regarding the aforementioned process will be shared with the public.
However, we would like to briefly share the following points with the public and you, our dear friends, in line with our principle of transparency:
As you know, the main motto of Açık Radyo is "Açık Radyo, a radio open to all the sounds, colors and vibrations of the universe". In this context, it is extremely incomprehensible and upsetting for us that our radio station is even alleged to have violated an article of the law stating that "'It cannot incite the society to hatred and hostility or create feelings of hatred in the society by making distinctions based on race, language, religion, gender, class, region and religious order.
As we have tried to express during the judicial process. from the moment it first went on air, Açık Radyo has always defended freedom of thought and expression and, as a natural consequence of this, freedom of the press. Freedom of thought and expression, and by extension, freedom of the press and freedom of the public to have access to information, are regulated in detail both in international conventions to which Turkey is a party and in our Constitution, and there are countless international and national judicial decisions to guide practice in this regard. Moreover, freedom of expression is one of the fundamental foundations of a democratic society and a sine qua non of pluralism, tolerance and open-mindedness.
Açık Radyo has been broadcasting in accordance with these principles for nearly 30 years since its establishment. In this framework, the Açık Gazete broadcast dated 24.04.2024, which is the subject of the RTÜK decision, was made in line with the same principles, and the evaluations in the decision are unacceptable according to universal principles of law and journalism.
As is known, Açık Gazete is a program in which news from many news organizations from both our country and the world are conveyed to the audience objectively, and the opinions expressed by guests on current issues are shared with the audience. The program has always prioritized the ethical principles of journalism. In this respect, there was no expression in the program on that given day subject to the penalty that exceeded the limits of freedom of expression and thought. Furthermore, when both the statements subject to the decision and the whole of the program in question are evaluated, there is no aspect contrary to the universal principles of journalism. In particular, it is not possible for the program in question to incite society to hatred and hostility and to create feelings of hatred in society.
It is also important to make the following point clear: Açık Radyo is a big family with all its programmers and listeners. All our programmers and listeners are of course aware of the value of freedom of the press and the great responsibility it brings, and have paid attention to these principles throughout our broadcasting life. We would especially like to emphasize that over the course of 30 years, more than four hundred of our programmers, nationally and internationally renowned experts in their fields, have always prioritized the principles of universal journalism in their thousands of programs, both in the field of news reporting and in many other fields such as law, philosophy, history, anthropology, science, culture, literature and art. We as Açık Radyo, will of course, continue to broadcast in line with the same principles and with the same responsibility.
We would like to thank all Açık Radyo friends who have stood by us during this process to support us in our defense of universal journalistic principles, and we would like to reiterate that we will continue to share all further development regarding the process with you and the public.
